Benjamin has a busy common law practice representing both Claimants and Defendants.  He has particular expertise in the field of personal injury including employer's liability and public liability claims at both fast track and multi-track level.  His personal injury work includes both fatal accident and industrial disease litigation.

He is frequently instructed in claims involving alleged motor insurance fraud including staged accidents, phantom passengers and low velocity impact claims.

Benjamin regularly represents both Claimants and Defendants in large credit hire cases.  He also has extensive experience of coroners inquests and of CICA appeals. 

He undertakes costs work (often appearing in the SCCO) and has experience of a wide variety of costs related disputes.

Notable Cases

  • Thames Trains v Railtrack (1) HSE (2): Benjamin was instructed on behalf of the HSE in the civil litigation arising out of the Ladbroke Grove train crash
  • R v Thames Trains (LTL 18/6/2004): prosecution of Thames Trains arising out of the Ladbroke Grove train crash
  • Alexiou (1) Ferguson (2) v Campbell (28/3/2008): acted for paying party in Privy Council taxation of bill of costs in the region of £400,000
  • Re Lewis (5/1/2009) acted for assaulted teacher in CICA appeal; awarded £280,000
