High Court disclosure decision in 'Guantanamo Bay Damages' litigation

Louise Jones appeared as junior counsel for the Defendants in Al Rawi & others v Security Service v Others [2010] EWHC 1496 (QB), a case management decision in the 'Guantanamo Bay Damages' litigation.  The Claimants' claims arising as a result of their detention and alleged mistreatment whilst detained in Guantanamo Bay. The Defendants have identified over 250,000 potentially relevant documents and the disclosure exercise is unprecedented in its combination of scale and complexity. Silber J referred to the claim as "massive litigation" with disclosure and inspection "unlikely to be completed for many years".Silber J has ordered that the Defendants provide disclosure of certain guidance material that was referred to in the Intelligence and Security Committee's reports in 2005 and 2007.
