Successful claim for employee in cancer claim following twenty years exposure to metal working fluids

Simon Browne QC acted on behalf of the Claimant in Pickering v
Eaton Aerospace [2012]. The Claimant was successful in an
industrial disease claim with regard to the development of cancer
sustained whilst an employee and exposed to working mineral oils
over twenty years. Breach of duty of care and causation were
denied. It was suggested that the type of cancer sustained could
not have been caused by the metal working fluids used. Following a
reserved decision judgment was entered for the Claimant on both
liability and quantum
