Young chronic pain sufferer awarded £1/2m

Marcus Grant, instructed by Tom Ranson of Ashton Graham,
appeared for the Claimant in a chronic pain case
before HHJ Reddihough sitting in the Reading County
Court. Aged 20 at the time of a rear-end shunting car accident in
February 2003, the Claimant was awarded c. £37,000 in 2007 in
respect of past losses in a trial on a preliminary issue of
clinical causation. On 20.12.10 he was awarded a
further c. £461,000 in respect of the balance of his claim
after a fiercely contested 5-day trial. The Court accepted the
evidence of Dr. Pither FRCA and preferred the evidence of Dr.
Davies FRCPsych to that of Dr. Wood FRCPsych and found the Claimant
and his family honest and reliable witnesses. The Defendant's
positive case that all of the Claimant's symptoms were attributable
to a pre-existing and unrelated Undifferentiated Somatoform
Disorder was rejected.
