Health & Safety

Temple Garden Chambers has long been recognised as one of the leading sets in this important and specialist area of law.  Chambers and Partners 2013 Guide to the Bar reports that Temple Garden Chambers offers "… quality counsel … at all levels of seniority. Its members whatever their level of call, have been involved in standout cases over the years … The barristers offer a very good service, are very organised and are excellent to deal with". Earlier editions reported that Temple Garden Chambers has a "prominent reputation among health and safety practitioners", "a strong reputation in advisory work for companies that want to ensure compliance with health and safety legislation". The Legal 500 added that we are "celebrated for the calibre of our many clued-up and committed juniors".

Members of Chambers are engaged in all aspects of health and safety law and enforcement, for defendants, those at risk of prosecution, prosecuting authorities and those seeking advice.

We regularly advise and represent individuals, corporations, government and other public and charitable bodies in relation to prosecutions, enforcement proceedings (such as Improvement Notices, Prohibition Notices and Crown Censures) and all aspects of compliance and policy. Some members of Chambers have particular expertise in representing clients at interviews under caution.

Members of Chambers have been involved with many of the most prominent and significant cases in recent years including: R v Cotswold Geotechnical (Holdings) Ltd (first prosecution under the Corporate Manslaughter and Corporate Homicide Act 2007), R v Balfour Beatty and others and R v Howe and Sons (Court of Appeal leading cases on sentencing), R v Southampton University Hospital Trust (first prosecution of a hospital under health and safety legislation arising out of the standard of clinical care and in the Court of Appeal the approach to sentencing public bodies).
